So while it’s « possible that one or more Meta employees » have downloaded Strike 3 content over the past seven years, it’s « equally possible » that a « guest, or freeloader, » or « a contractor, or seller, or repair person—or any combination of such persons—was responsible for this activity, » Meta claims.

Other alleged activity includes an allegation that a Meta contractor was directed to download adult content at his father’s house, but those downloads are also « clearly indicative of personal consumption, » Meta claims. That contractor worked as an « automation engineer, » Meta noted, with no apparent reason provided as to why he would be expected to receive AI training data in that role. « There are no credible facts » linking « Meta to these downloads, » Meta claims.

« The fact that the torrenting allegedly stopped when his contract with Meta ended says nothing about whether the alleged torrenting was done with Meta’s knowledge or direction, » Meta wrote.

Meta slams AI learning theory as ‘nonsensical’

Perhaps most confusing to Meta in the Strike 3 complaint, however, is the claim about the « stealth network » of hidden IP addresses. This presents « yet another conundrum » that Strike 3 « fails to address, » Meta argued, writing, « why would Meta seek to ‘hide’ certain alleged downloads of plaintiffs’ and third-party content, but use easily traceable Meta corporate IP addresses for many hundreds of others? »

« The obvious answer is that it won’t, » Meta argued, criticizing Strike 3’s « entire AI training theory » as « nonsensical and unsupported. »
